1. General provisions
These Terms of Use (the "Terms") govern the relationship between the operator of the LOKACIA platform (the "Platform"), Private Company Arvo Labs Limited, and the users of the lokacia.kz service. By registering on the Platform, you accept these Terms in full. The Platform is a marketplace connecting venue owners (hosts) and renters. The Platform is not a party to the rental agreement.

2. Participants
Host — a user who lists a venue for rent. Only an individual entrepreneur (IE) or a legal entity may act as a host. The host warrants that they have the legal right to dispose of the venue and bears full responsibility for the accuracy of the information in the listing.
Renter — a user who books a venue through the Platform. A renter may be either an individual or a legal entity. The renter undertakes to use the venue in accordance with the host's rules and the applicable laws of the Republic of Kazakhstan.
3. Commission and payment
For bookings, the Platform charges a service commission: 15% from the host and 5% from the renter. The payment provider's acquiring fee is paid separately. Bookings are paid through the payment provider PayLink.kz after the host confirms the request (for instant bookings, immediately after the booking is placed); no funds are charged or held when the request is submitted. From the moment of payment, the funds are held by the payment provider and transferred to the host after the event is completed, net of the service commission, within the time frames set by the payment system. (The exact procedure and timing are set by the agreement with the payment provider.)
4. Cancellation and refunds
The renter may cancel a booking in accordance with the cancellation policy the host has chosen for the venue: "Standard" (full refund if cancelled 7 days or more before the start, 50% from 24 hours to 7 days, no refund under 24 hours) or "Firm" (full refund 7 days or more before the start, no refund later). Full terms are set out in the Cancellation and Refund Policy. The Platform reserves the right to issue a full refund in case of force majeure.
5. Liability of the parties
The Platform is not liable for the quality of the venue, the actions of the host or the renter, or damage caused to property during the rental. Disputes between the host and the renter are resolved by the parties themselves. The Platform may act as a mediator at the request of either party. In case of systematic violations, the Platform reserves the right to block the user's account.
6. Intellectual property
All Platform materials (design, texts, logos, software code) are the property of the operator (Private Company Arvo Labs Limited) and are protected by the copyright laws of the Republic of Kazakhstan. Photos and descriptions uploaded by hosts remain the property of the hosts. By posting content on the Platform, the host grants a non-exclusive licence to use it for promoting the Platform's services.
7. Changes to the Terms
The Platform reserves the right to amend these Terms. Users will be notified of material changes by email at least 14 days in advance. Continued use of the Platform after the changes take effect constitutes acceptance of the new Terms.
8. Governing law
These Terms are governed by the laws of the Republic of Kazakhstan. All disputes not settled through negotiation are subject to the courts at the location of the Platform (Almaty).
